Terms of Service

Gatherings and sessions are scheduled in advance and are not for emergency response.

1. Overview and Acceptance

These Terms of Service ("Terms") govern your use of adamrodriguez.io (the "Site") and of what Adam Rodriguez ("Adam," "we," "us") offers through it: the weekly gathering (the "Gathering") and one-on-one sessions (each a "Session"). The Gathering and Sessions are provided through Metaplexus LLC, a Texas limited liability company.

By registering for the Gathering, or by booking, paying for, or taking part in a Session, you agree to these Terms, the Privacy Policy, the Disclaimer, and the Participant Acknowledgment and Waiver. If you do not agree, do not register or book.

2. The Gathering

The Gathering is a weekly online meeting held on Zoom where participants come together to talk, listen, and share where they are. It is a peer space held by Adam. It is not therapy, counseling, coaching, a support group led by a clinician, or any other professional service.

Nothing said in the Gathering is advice. What you take from it, and what you do with it, is your own choice.

Registering gives you the details to join. The schedule, format, or link may change, and a Gathering may be cancelled or paused at any time.

3. Conduct in the Gathering

To keep the space safe for everyone, participants agree to:

Keep what others share in the Gathering private. Do not repeat it outside the Gathering in a way that identifies them.
Listen without interrupting, judging, or giving unrequested advice.
Not record, screenshot, or stream any part of the Gathering.
Not use the Gathering to sell, recruit, or promote anything.
Not harass, threaten, or demean anyone.

Adam may mute or remove any participant, and may decline future registrations, at his discretion.

4. Voluntary Contributions

The Gathering does not require a fee. Anyone who wishes may offer a voluntary contribution as an act of generosity. A contribution is a gift, not payment for a service. It does not purchase any right, benefit, or outcome, it is not refundable, and it is not tax-deductible. Metaplexus LLC is not a charitable organization.

5. One-on-One Sessions

Sessions are private conversations with Adam. They may touch on topics such as psychedelic integration, fitness, nutrition, and general life direction. Sessions are offered by mutual agreement. After you send a request and Adam agrees to a Session, you receive a booking link that states the length and fee of the Session.

Sessions are non-clinical. Adam is not a licensed therapist, physician, dietitian, attorney, or financial advisor, and a Session is not a substitute for any of these. Read the Disclaimer before booking.

6. Eligibility

The Gathering and Sessions are for adults 18 years of age or older. By registering or booking, you confirm that you are 18 or older and that the information you provide is accurate.

7. Payment

Session fees are charged in U.S. dollars at the time of booking through Stripe. The fee shown on your booking link is the fee you are charged. Sessions are not eligible for insurance reimbursement. You are responsible for any taxes or obligations on your end.

8. Video Delivery and Technology

The Gathering and Sessions are held by video conference, ordinarily Zoom. Join from a private space with a stable connection. If a Session is interrupted by technology failure, we will try to reconnect within 10 minutes. If that fails, the remainder will be rescheduled or prorated, at Adam's discretion. No electronic communication is fully secure, and by joining you accept that limited risk.

9. Refunds

A full refund is available within 24 hours of payment, as long as the Session has not yet taken place. After 24 hours, no cash refunds are issued. The Session value is held as credit toward a future Session for 90 days from payment, then forfeited.

Documented emergencies may be considered for a refund or extended credit at Adam's discretion. To request a refund or use credit, email contact@adamrodriguez.io with your booking confirmation.

10. Scheduling and Cancellation

Sessions can be rescheduled with at least 24 hours notice. Less notice, or a missed Session, is applied against the 90-day credit window. If you are more than 10 minutes late without notice, the Session is treated as cancelled. If Adam is more than 10 minutes late or misses a Session without notice, you may reschedule at no charge or receive a full refund for that Session.

11. Recordings

The Gathering and Sessions are not recorded. You may not record any part of either without Adam's prior written consent. Unauthorized recording may result in removal without refund and may violate applicable law.

12. Intellectual Property

All content on the Site, including text, graphics, design, and code, belongs to Adam Rodriguez or Metaplexus LLC and is protected by copyright and other laws. You may not copy, republish, or create derivative works from it without written permission. Notes or material shared with you in a Session are for your personal use only.

13. Confidentiality

What you share in a Session is kept private as described in the Privacy Policy, except where disclosure is required by law or where there is a credible threat of harm to you or others. Because these are non-clinical services, clinical confidentiality and recordkeeping standards do not apply. In the Gathering, confidentiality depends on every participant honoring Section 3, and Adam cannot guarantee that others will.

14. No Guarantee

Nothing offered through the Site diagnoses any condition, predicts any outcome, or guarantees any result. Your choices, and what follows from them, are your own.

15. Ending Participation

Either you or Adam may end a working relationship at any time. Adam may decline Gathering registrations or Session bookings in cases of harassment, threats, abusive conduct, repeated missed Sessions, non-payment, or behavior that puts others at risk.

16. Third-Party Services and Links

The Site and services rely on third parties such as Zoom, Stripe, and Calendly, and the Site may link to other websites. Those services are governed by their own terms and policies, and we are not responsible for them.

17. Limitation of Liability

To the maximum extent permitted by law, Adam Rodriguez and Metaplexus LLC are not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to the Gathering, any Session, or your use of the Site, under any theory of liability.

Where applicable law sets a limit that cannot be excluded, liability is limited to the lesser of that limit or the total fees you paid for the Session giving rise to the claim in the twelve months before the claim.

18. Indemnification

You agree to indemnify and hold harmless Adam Rodriguez and Metaplexus LLC from any claim, loss, or expense, including reasonable attorneys' fees, arising from your violation of these Terms, your conduct in the Gathering, or inaccurate information you provide.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

20. Dispute Resolution

Before any formal legal action, you agree to send a written description of the issue to contact@adamrodriguez.io and allow thirty (30) days for a good-faith resolution.

21. Force Majeure

Neither party is liable for failure or delay caused by circumstances beyond reasonable control, including natural disaster, illness, pandemic, government order, or internet or platform outage.

22. Severability and Entire Agreement

If any provision is held unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, the Disclaimer, and the Participant Acknowledgment and Waiver, are the entire agreement between you and Adam regarding the Site, the Gathering, and Sessions.

23. Changes

These Terms may be updated from time to time. The date at the top shows the latest revision. Continued use after an update means you accept the revised Terms.
